    Introduction

    Broker Mandate / Power of attorney and mandate for the management of the insurance portfolio
    Between
    hereinafter referred to as “Client”
    In cooperation with the brokers
    Swiss Prime International AG
    Alpenstrasse 14, 6300 Zug
    hereinafter referred to as “SPI”
    AND
    Swiss Prime International Geneva AG
    Avenue Louis-Casaï 18, 1209 Geneva
    hereinafter referred to as “SPIGE”
    together: the "brokers"

    The Client issues the Broker with the authorisation and the assignment to administer the existing insurance policies through Swiss Prime International Ltd.

    The agreement on the administration of the insurance portfolio also encompasses the following services:

    • Supervision of existing insurance agreements
    • Examination of the insurance requirements and the insurance portfolio
    • Periodic examination of the premium offers on the insurance market
    • Obtaining of offers from various insurance companies
    • Assumption of renewals and the conclusion of new policies

    The Client shall remain the policyholder and debtor for the premiums. He shall sign insurance applications himself and directly accept compensation payments. The Client commissions the companies to transfer all agreements and existing policies to Swiss Prime International Ltd. The Broker shall represent the Client in all remaining matters vis-a-vis the insurance companies.

    The following documents are to be sent from the companies to Swiss Prime International Ltd for processing:

    • Policies, supplements, amendments to contracts, premium invoices, reminders, copies of the other correspondence
    • Offers for the Client as well as the other correspondence

    The Client expressly wishes not to be called upon by sales representatives of the companies. The Brokers can conduct negotiations in the name of the Client and undertake the necessary clarification and measures for drafting contracts.

    Any other changes in factual matters which influence the insurance cover are to be reported immediately to the Broker by the Client so that the insurance cover can be reviewed and adjusted (e.g. change of activities or expansion of scope of services for companies, etc.). If the Broker is not informed of changes as they occur, the Broker shall not be liable for the lack of cover in the event of the occurrence of the insured event. The liability of Swiss Prime International Ltd is excluded pursuant to Art.3 of the General Terms and Conditions of Business.

    This agreement shall come into effect for an indeterminate period upon its being signed by all three parties and shall remain in effect until such time as it is revoked. The signing parties confirm their agreement to the provisions of this Broker’s Mandate. Furthermore, with his signature, the Client confirms receipt and acknowledgement of the General Terms and Conditions of Business (VAG Art. 45) and that he has been informed of the terms and conditions of compensation (Art. 5 of the General Terms and Conditions of Business).

    This Broker’s Mandate shall be valid in full from the date of signature and can be dissolved at any time.

    5. Swiss Prime International AG cooperates with the above mentioned companies, depending on the insurance needs of the client in all insurance classes. Swiss Prime International AG is compensated by the insurers with the customary brokerage commissions.
    6. Swiss Prime International AG works on behalf of its clients in accordance with the services agreed in the "Broker Mandate".
    7. In the event of a complaint: As our client, you are always assured of our commitment to sound and impartial financial advice. Nevertheless, should an error occur, we will do everything possible to resolve this to your entire satisfaction. As required by article 45, ISA, Swiss Prime International Ltd. can be held responsible in the event of errors, negligence, incorrect information, or erroneous financial advice. Swiss Prime International Ltd. maintains professional indemnity of CHF 2’000’000 with Allianz-Suisse
    8. Your confidential data: Swiss Prime International Ltd. ensures that its consultants and staff treat your sensitive information with the utmost care and discretion, following the principles of relevant Swiss law. Our data conservation policy is also governed by Swiss law. The use of your personal details, including any and all information provided to us in the scope of our activity as financial consultants, are treated with total confidentiality, and accessed exclusively for the purpose of fulfilling the obligations of our mandate with you. Personal data is generally stored in electronic and/or paper form. All information provided by the customer will be disclosed to third parties only with the express written consent of the customer.
    9. SPI AG typically receives a service fee for the administration of insurance policies, with the compensation amount varying depending on the type of insurance. For completed policies, SPI AG receives a one-time commission, and in some cases, a recurring commission. The compensation amount falls within a narrow range applicable across different providers. Detailed information is available on the website at https://swiss-prime.ch/en/terms-and-conditions/ (GTC). The client explicitly agrees to waive the right to receive compensation. In return, SPI AG does not charge any consulting fees for its services. SPI AG is always willing to transparently disclose the amount of compensation received upon request.
